Under the Tripartite Pact Germany had no obligation to declare war or take hostile action against the USA unless we attacked one of the Pact signatories first. It was we who were attacked by a Pact signatory. Hitler then declared opon us without having the obligation to do so. We responded with a counter declaration against Germany. en.wikipedia.org
