Jeff, I don't know how INVT needs to handle the lawsuit against bashers. I personally would not have played that card at this time so we'll see what comes of it.
Moving the price up and down on reasonable buying or selling is expected but I think it's wrong that MM's on otc/bb stocks can naked short to the extent that they do(virtually unlimited). They often take their naked positions far beyond what would be considered necessary to make a fair market. And then when a company turns out to have more than the typical bb does (in the way of a real business) it's no longer in the MM's interest to make a "fair market" because that would go against the position in which they have shorted themselves. I would like to see enforced regulation by SEC extended to include all MM activities on the otc but I believe we'll see electronic trading (which cuts out the MM) before that happens. It is coming imo.
As for a fair value/price in a otc/bb?? Good question... Although MM's and ethics don't mix, I don't think the system "sucks". I don't really know how else to change it. Experience has taught me how to prosper within the otc badland as it is. I'll adjust my strategies as the rules change. At least by the end of summer all otc listed stocks will comply with the sec reporting requirements so that'll be a start but your point is made.
