I think the simple answer is confusion

I think another simple answer for what happened is:
LOBBYISTS

The large pharmaceutical companies who are "demanding" this information be free, without realizing they cannot use the raw data spend huge amounts on lobbyists. Some of the biggest spenders I believe.
