Microsoft is now being sued directly under Sherman 2, and it is irrelevant what the DOJ knew or didn't know they were going to do in 1994-95.

Right, Gerald. I was going to say that, but I'm disengaging a bit these days. Bill's picked up some cheesy high school debate technique somewhere, I wonder if he has a new legal advisor telling him Microsoft has done nothing wrong. We're not talking consent decree anymore, unless it's a new one, and after Bill's cheesy bait and switch last minute negotiations, a new consent decree is dubious.

Old timers here who remember more than is good for them will recall Gerald being skeptical about the whole consent decree action, and saying DoJ should just do things right, build a case and file a suit the old fashioned way instead of trying to make something out of Anne Bingaman's failed attempt at negotiation. Microsoft attorney Urowsky more or less dared Justice to do the same at the first hearing in front of Jackson. Personally, I'm amazed at how fast things are moving. The wheels of justice are supposed to grind slowly, a September trial? This isn't your father's IBM antitrust action.

Cheers, Dan.
