Why would IFX settle and settle soon?

a. New CEO wants a clean slate - Shuesmacker was fired for letting his ego get in the way

b. They just won a $ 160M verdict in another infringement case - this offsets the DOJ fine - they are liquid and have reserves set aside

c. They need the new technology such as XDR - otherwise they must either steal it or be out of business in 3 years

d. Elphida CEO stated the other day - "only 3 companies will remain and we will be one of them" I think IFX would like to be there alongside Samsung

e. Hynix has no money (the owners, banks, do but I don't think they are ready to dish out a lot of dough to rambus at this point. Korea already has Samsung and Samsung might take over Hynix with pressure from the Korean Government.

f. IFX would get a head start in front of Micron and Hynix and can use that as a competitive advantage

g. They already know what's out there for evidence in the hands of the DOJ, FTC and soon completed and catalogued by rambus to be presented at appeal.

h. By the time the appeal comes around the market will have moved to faster and new DRAM and CELL technology largely based on rambus IP - IFX won't have access and will be left with the capability to produce producs that are obsolete

i. Settlement now will also make the AT suit go away - this one is far more costly than the infringement suit/appeal

j. A SJ or a verdict in favor of Rambus in the Hynix trial is a scary thought for IFX - it could be fast approaching

If I was running IFX I would settle now, put this behind me and hope to take a fair share of the ever increasing market for memory (which will explode in 2007 when the entire US needs new TV's or set-top boxes with high-bandwith inside).

A settlement should drive the stock past $ 70.00 in short order.

All above just my 2c and own opinion/speculation (which some large Rambus investors with a lot of knowledge happen to agree with).
