Section. 3.
Clause 1:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

That's treason.

Not even close.

"Enemy of the state" sounds like a charge from Soviet Russia. In this country you have to be charged with specific crimes. And burning a flag is not a crime.

The United States Supreme Court has ruled that it is a form of political expression, that political expression is protected under the 1st Amendment, and that therefore it is not illegal. Making it illegal would be the same as saying that the words that come from the mouth of the person doing that burning are illegal. Gnerally they don't just burn a flag; they speak, yell, and carry banners. All of which are and were meant to be protected by the Bill of Rights.
