Vical has licensed to Merck the DNA vaccine rights for HIV and several other vaccines. The Apollon use of DNA may be an infringment on one of the Vical patents. They use a local anesthetic as a adjuct which has never, as far as I can find out, been shown to be substantially different from the Vical patent. (The Vical patent is on the web and if you read it you will see that it excludes only a few things which probably don't work.) If the Apollon group brings a product to market they will have to pay Vical royalties (in the high single digits of gross sales)and if there is a patent suit, Merck will probably bear the cost as they stand to loose more than Vical. On the other hand, Apollon has a lot of press releases while Merck plays close to the chest and lets NO ONE know what their results are.(Just try to find out what the antibody titer or challenge results are on the people they have injected with Vical's naked DNA influenzia vaccine.) If they, Merck, were not onto something why would they have so many people working on DNA vaccines ( more than work at Vical) and why in their public statments of their pipeline of drugs would they place so much emphasis on DNA vaccines? Bottom line is that(I suspect)Merck is far ahead of everyone in developing an HIV naked DNA vaccine, in addition to the DNA influenzia vaccine.
There is no doubt in the minds of most in the scientific community that DNA vaccines will work and the only question is how soon a product will be brought to market. All of the above is public knowledge to the community of web searchers. I have no inside knowledge, only what I know from a biology background and web searching.)
I have held Vical for some time, up and down, but expect it to have been a bargin in about 2-5 years.
