The 9th Circuit's majority intentionally ignored binding Supreme Court precedent. Not only that, the Supreme Court already has taken up a similar case that should be decided within the next few months. The prudent thing for the 9th Circuit to have done was to delay decision of the case pending the Supreme Court's ruling.
