Verdict In Rambus v. Infineon Could Come By Wed>RMBS INX By Michael Buettner Of DOW JONES NEWSWIRES (This story was published late Monday) RICHMOND (Dow Jones)--As jurors heard final evidence in the legal battle between Rambus Inc. (RMBS) and Infineon Technologies AG (IFX), court observers said they expect the case to be handed over to the jury Tuesday, with a verdict possible as soon as Wednesday. Attorneys in the case said late Monday they expect U.S. District Judge Robert B. Payne to schedule summations and jury instructions Tuesday. While filings of last-minute motions could delay giving the case to the jury, Payne made it clear during Monday's session he would not encourage such filings, particularly any raising issues not argued previously or offering new arguments in support of previously raised issues. Payne had said during pretrial hearings in April that he intended to move the case as expeditiously as possible. Monday afternoon, jurors heard videotaped and live testimony presented by Rambus rebutting evidence offered previously by Infineon, which claimed Rambus committed fraud and racketeering violations in obtaining and seeking to enforce its patents on computer chip memory systems. Earlier Monday, Payne denied Rambus' motion to dismiss those claims. The case originally was brought by Rambus, which sued Infineon for alleged patent infringement. Last week, Payne dismissed all of Rambus' infringement claims. The case was brought at federal court in Richmond because German-based Infineon's largest U.S. operation is located here. Rambus shares closed Monday at $13.50, down $1.10, or 7.5%, after falling 19.6% Friday.
