Well I wouldn't know what is actionable, but there's no law that says companies are required to preannounce bad earnings. Lots of them don't.

Look at it this way: Say HWP stock had trudged along at $62ish. Then HWP preannounces say two weeks ago that they think they will be at least 10 &cent light. Stock still falls overnight, say down $3-5 to $58-$60. But today, the stock falls $10 overnight and is still at $72ish.

Seems like the shareholders are better off at $72 than $60. Except for those that bought in the $75-80 range - but hey - that's the dangers of momentum "investing".
