Sure. But you can still have a legitimate democracy alongside a theocracy. In Iran, though, they don't, because the mullahs can override any legistlative, judicial, or executive decision.

If in Iraq, the constitution is Koran-based, and their laws use the Koran as their foundation, that is fine. It's only if Sistani or other mullahs decide they have to review every law and if they decide to exercise their power to veto laws, etc, that it becomes a problem. In that case, you will have an oppressed population that will turn to terrorism again, with the West as its prime target to vent its frustrations on.
