It is my current understanding that the blood alcohol level of the driver was the equivalent of a single glass of wine. Without knowledge of the physical size of the driver, one cannot determine whether or not the driver was impared.

You fail to suggest that the motorcyclists may have in fact contributed to the accident through their behavior. If the driver felt threatened by the motorcyclists, then they have contributed to this tragedy.
