You dont seem to understand the law, The dealer is not evading taxes, the customer is. You see if you go to a store to buy a shirt and have it shiped home to another state you the consumer dont pay taxes on it. IE you save the 8% or whatever your rate is. The store owner gets NO BENIFIT From this action. In actuality if the dealer gets audited he still is not responcible for the tax the buyer is. There is no dealer that would knowingly break the law and risk audits, jail and fines for no financial gain. I am asked on every transaction I make if I can do this or that to help the consumer save taxes. I wont nor will most dealers unless put under intense pressure by customers. What was increadibly Stupid on Kozlofisky's part was that he should have had the dealer send the pictures legitimatly to his home in Florida. Then he could have done what he liked with the pictures, even send them to NY. It would be difficult to prove what his intention for that painting was if he said "I bought it then I decided it would look better in ny" yada yada.... If he said that in the article he is flat out lying, any inteligent person who has ever dealt with sales tax in NYC would see through that arguement. Who was the dealer? I probably know them???
