hasan, I agree with you. Even with the current DOJ, there may be some hesitation to take a hard line attitude towards this merger.

The timing (election) for the merger is perfect, especially as JDSU will can probably delay submitting information upon a second request (until the new administration is in) if they feel the questions raised by the DOJ signal something they don't like. So far it looks like they are getting along pretty well. After all, the current DOJ does not want an anti-business label. I think this one gets approved.

It is very different from those deals that involve consumers directly--airlines, long distance. In those cases, the DOJ may take even tougher stances than it is warranted since they believe the public will be on their side.
