"Now why would DAY want to settle our case and avoid litigation if we never owned the properties as DAY claimed????"

A certain "Dog" that posts on the Yahoo Board has given us some clues.

"Mdog,

I read the same post on RB as well. What disturbs me most is there has been no mention in any recent DAY news releases regarding this litigation.

And where do you suppose Dayton will find new ore in the Andocollo Region that is economically worth while to mine at today's gold prices and actually mined from it's legally owned property? From Medinah Mining, Inc perhaps?

And hasn't Dayton always STATED in their new releases the following: "Dayton Mining Corporation holds a 100% interest in the Andacollo Gold Mine in central Chile." How could this even be remotely possible?"

Excerpts from this Medinah news release.

http://www.medinahenergy.com/newsreleases/June17,1998.html

"In June and July, 1998, the Defendant published information in its 1997 annual report and in press releases alleging that the Defendant holds mineral titles and surface rights to all land which covers its published reserves, resources, and mine plan at Andacollo. The Plaintiff's Rodrigo, Mercedes, Gabriella and Toro properties and the properties over which it has rights of first refusal, aforesaid, are all clearly inside the stated reserves, resources and mine plan of the Defendant."

"The actions of the defendant in falsely and maliciously publishing the aforesaid information, without lawful occasion or excuse, has brought into question the Plaintiff's ownership of the Chilean properties referred to above, and the Plaintiff has suffered loss and damage thereby, including but not limited to, loss of ability and opportunities to arrange financing, and damage to its general reputation."

Hmmmmm?
