Perhaps it’s time to revert to a much older marital tradition. Let churches decide which marriages they deem “licit.” But let couples — gay or straight — decide if they want the legal protections and obligations of a committed relationship. I have never, ever, had anyone ask me for proof of my marriage. When filling out an application for insurance benefits, I just put down married, and my wife was covered under my policy. I have never seen the courts question validity of a marriage in a probate proceeding. I guess where one would run into problems with just declaring a marriage without benefit of state approval (license) would be if the relationship ended and the couple ended up fighting over property.
