Appeals Court Delivers Blow to EchoStar, DirecTv

A Federal appeals court has ruled against Echostar Communications Corp. and DirecTv in their challenge to a 1996 Federal Communications Commission auction of Advanced Communications Corp.'s satellite license, reports Bloomberg News.
The 3-0 ruling means that MCI Communications Corp. has the rights to most of the prime channels dealt in the $735 million auction, which saw DirecTv get no Advanced channels and Echostar only ones of lower value.
DirecTv and Echostar had argued in their challenge that the FCC should have sold the Advanced channels exclusively to companies already possessing direct broadcast satellite licenses (MCI had no DBS license), but Federal Appeals Judge Douglas Ginsburg wrote that the commission presented "a reasoned explanation of why it believed an auction would best serve the public interest."

I do not think we have much to worry about. Maybe this will teach DirecTV & Echostar to teach their lawyers to heal; fetch is not working. :o)
