Eugene Volokh offers an analysis of the New Jersey Same-Sex Marriage decision, arguing that the majority opinion illustrates the reality of the “slippery slope” phenomenon. Volokh shows how New Jersey’s supreme court justified its decision by referring to earlier gay rights laws, even though in a strictly logical sense, those laws can easily be distinguished from same-sex marriage. But what really makes Volokh’s post powerful are the quotes he’s collected from sponsors of these earlier limited reforms. The early reformers scoffed at the claim that their modest proposals might someday lead to gay marriage. Yet that is exactly what has happened.
