Its still very clearly unconstitutional in terms of what the constitution actually says.

My statement about what the court's decision was also accurate. At the time when I posted that it was indeed true that "it hasn't yet been established as constitutional (in the opinion of the Supreme Court" and nothing that has changed since then makes that statement false (it would make a new identical statement false, but that statement was about the time in question not now, and so was true).
