Given the outrage of the Court of Appeals at Judge Jackson’s bias in the largest anti-trust
case in the history of our nation, one would hope they’ll act decisively to restore
confidence in our judicial system. To remand and retry under a different judge won't be
enough, since it will only cause MSFT to exhaust more time and energy, and will do
nothing to help repair the mess created by Judge Jackson. The most straightforward way
to rectify the situation would be to overturn the case, and exonerate MSFT. To do less
than that, without punishing the judge’s behavior, would only encourage such biased
behaviors in the future, if not in this judge, then in others. If the judge is simply removed
from the case, he’ll have achieved the goal inherent in his expressed biases, which is to
prolong the agony of the litigant, while making a mockery of the justice system.
