The restatement went back one year (I'm pretty sure). Anyone considering buying based on the financial statement would have been "misled" by the figures. Anyone who bought prior to that didn't have anything restated so they don't have a case - not that I think there's a case here, either.

Those of us who were already in weren't misled because we didn't use the information to make a buying decision. We could argue that we decided to stay in based on that, but that's even more of a stretch than those that bought.

I don't know for sure, but I think this is the basis of the suit. It just means that the lawyers will make some money. It was probably a lawyer who's suing in the first place. Just a waste of everyone's time.
