"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

This is imo the most abused section of the Constitution other than, perhaps, the Commerce Clause.

Yesterday I was doing some online research concerning whether it was legal for me, as a resident of Florida, to carry on my person a small folding knife (I don't have a carry permit for guns and other weapons yet, but will be getting one). It turns out the law is unclear ... there have actually been Florida Supreme Court cases on the issue.

So how do we get from:

"the right of the people to keep and bear Arms, shall not be infringed"

To:

"Redfish is unsure whether it is legal for him to carry a folding knife"?

The anti-weapons people claim it is due to the following:

"A well regulated Militia, being necessary to the security of a free State"

However in that clause the framers are merely telling us WHY they decided that the right to bear arms cannot be infringed ... they certainly did not mean for the clause to serve as JUSTIFICATION for the right to bear arms to be infringed.

The fact is that they voted for and confirmed a Constitution that provides there shall be NO INFRINGEMENT.

I recognize that a significant portion of our nation believes that law abiding persons should not be permitted to carry any type of weapon ... but the way to get to the result is to propose an amendment to the Constitution, not to turn a blind eye to what the document, which they supposedly cherish, actually says.
