Dave:

Back when Fonar "won" Nov. 85(?) the stock was around $9. In Jan 86(?) when the
trial judge overruled the jury it dropped. About in the same period of time Medicare rules
changed so doctors couldn't own the centers they referred the patients to. A double
hit for Fonar. Fonar's appeal of the judges decision wasn't resolved until about 6/87(?). Appeals
court upheld the trial judge. It has been about 2 years since I spend a day in the library running
through NY Times articles on this so excuse my lack of conviction on the exact dates.

I am surprised that Toshiba hasn't settled yet. It seems a very expensive gamble to
wait to see how the GE arguments and/or decision goes before working out a deal.

Profit in the 4th quarter? Only the settlement money gave them one before. Don't know how they
had the nerve to announce sales (7/25) but still haven't released the financials. So they'll release the
96 annual numbers on the last day of the 1st quarter 97. Why do I lack confidence in this management team?
