Neogen Wins Gold Nugget Trademark Lawsuit
LANSING, Mich., Nov. 23 /PRNewswire/ -- Neogen Corporation (Nasdaq: NEOG - news) announced today that it has won a three-week trial involving important company trademarks against two defendants, Arthur J. Trickey, d/b/a Manufacturing Contractors, Inc., and Arthur M. Trickey.
A jury in U.S. District Court in Grand Rapids, Mich., found unanimously in favor of Neogen on four of its claims, including fraudulent misrepresentation. The jury also unanimously rejected all of the counter-claims filed by the defendants against Neogen.
The jury's decision has two immediately beneficial ramifications for Neogen, its investors and distributors:
The decision means Neogen can continue to use its popular Gold Nugget® trademark for its line of quality, over-the-counter equine products, and in addition, the Company retains the rights to individual product trademarks, including two of Gold Nugget's top performers, Gnat-Away™ and ThrushCrusher™; The decision also puts a definitive end to a three-week trial that followed a prolonged period of litigation between Neogen and the Trickeys.
