Mark, This suit is actually quite old news. STMD sued Maxtor over a year ago. Their claim is that Maxtor tried to return product for non conformance when, in fact, Maxtor just wasn't able to meet their forecasted sales. That is over simplifying but you get the drift I'm sure. In any case, looks like Maxtor's attorneys have successfully eluded the suit thus far and STMD is trying to push it to a state court and repress. This suit, by the way, is the straw that broke my back in terms of investing in STMD. To me it was bad news that things got so out of hand and it suggested an argument that STMD did not manage the situation well. Maxtor's recovery and STMD's fall in fortunes suggest I may have been right (one of the few times I assure). Best, Stitch
