The form you must file is ST-44. And I quote from the instructions of this form "Use tax is a type of sales tax designed to distribute tax burden farily among Illinois consumers.... Illinois law REQUIRES that when you buy an item from another state or country to use in Illinois, you pay tax at the Illinois rate. "

I would bet almost every state has the same thing. Legislation already exists to cover this issue. What is lacking is a way to enforce it.

Another factor is that if a entity has a presence in that state they are required ot collect sales tax. However, I know that many companies don't do this in violation of the law. For example, I bought something from buy.com which is based out of IL but ships from a warehouse in IL. They didn't collect tax even thought they should have.
