The context within which a comment is made does indeed effect its impact and in a number of cases its legal consequences.

But the original statement I responded to was not specific to a location so it presumably was meant to be applied everywhere

"A female has the right to wear provocative clothing without having to worry about comments in public that would cause her to feel uncomfortable or vulnerable with regards to her gender. Or at least if she is made to feel uncomfortable, she can expect the system to support her in putting a stop to it."

Even in a workplace I don't think a single comment of that type should result in any action by the government against the speaker, even indirect government action, where the threat of government action forces the business to discipline of fire the worker.
