Wow - I hadn't read about that. What is the basis that the hedge fund claims to be suing? It's hard to imagine them filing papers with a straight face when they visited the clerk or were in front of the judge. I guess it's true that anyone can sue. However, there are many penalties, e.g., sanctions, punitive damages, for those who use the courts by filing frivolous lawsuits, by being vexatious litigants, for abuse of process, for malicious prosecution of a claim, for use of the courts for invasion of privacy, etc. Much of what you post is true with respect to the so-called basher community and the author's commentary is most apt to message board threats and hypocrisy that is so common.
