It's federal law backed up by SC decisions... Overview of U.S. Legislation and Regulations Affecting Offshore Natural Gas and Oil Activity eia.doe.gov I think the feds can go ahead without state approval, but for political reasons are reluctant to go against the voters of heavily-populated states like California and Florida... Keeping all that acreage locked up while oil was cheap seems like a pretty savvy move in retrospect. But as prices rise I sense a growing opportunity to peel off some of the opposition, with the right incentives...
