The policy decision to prosecute terrorists as criminals dates back decades. Look how we handled the Lockerbie incident, which occurred in 1988.

The difference between then and now is that the Taliban was adamant about protecting Bin Laden. If they had been willing to turn him over, we would not have gone to war against them.

Similarly, if Saddam had been willing to allow unfettered inspections by UNMOVIC, he'd still be in power. No, scratch that, maybe he lost it when he threw UNSCOM out.

So, I do disagree with Mylroie about prosecuting state-sponsored terrorists as criminals - but if her point is that we should have put more resources into drying up support for Al Qaeda and other terrorist organizations earlier, I agree with that 100%.
