An additional but perhaps overlooked idea regarding "open access" is that even if, it becomes a requirement that ATT and all cable operators open their cables to alternative ISPs, the inherent bundling that ATT/TCI will be able to offer the subscriber still makes the choice of TCI@Home a likely choice. Using myself as an example, I don't really care who my service provider is as long as the quality of service is high. I can change my home page anytime I want and so even though today US West is my ISP, I don't Start at USWest's home page, I choose the NY Times or anything else.
If you look at the current pricing of the TCI@Home solution, it is currently cheaper than what other high speed access combos cost. I pay an ISP fee of $17.95/mo plus the lease of the DSL line ($30/mo for 256K). TCI@home provides the ISP and line for $40/mo. This rate is competitive and cheaper than the alternative and at this time is a better deal since cable access is in its early stages (not everyone in the neighborhood is on) and is much faster/$ than DSL. The only reason I don't use TCI in my area yet is that it isn't available. When it becomes available, I am likely to try it.
The point of this numbers excercise is to show that it is highly unlikely that open access is going to prevent ATT from going ahead with a full build-out. Of course, they make more money if they can force everyone to take TCI@Home, but I am convinced that the eventual bundling of cable, Internet access, home security, and telephone on their cable makes their build-out not only highly likely but inevitable. (Notice Paul Allen's rush to own cable. He too, sees the potential of multiple services on the cable) They (ATT) must sue the municipalities however just to try to get their way. They are going to build. I repeat, they are going to build and build fast. IFCI is fortunate to have them as a client/customer since ATT will move very aggressively.
