Evolved nations have and are banning it.

I don't consider the US to be any less evolved than say the UK or France.

I disagree, although I do think that some of the death penalties supporters exaggerate the level of deterrence.

If it is well administered and only used in the most serious crimes I don't think I agree.

Which brings us to the only point of yours that I think might have some measure of validity

I can agree with difficult. But then depending on what you mean by "fairly" I may not consider it a major issue.

My main concern about fairly is that it is used to punish the guilty and not the innocent.

If you start off with the assumption that the death penalty is unjust or morally wrong then its wrong no matter how fairly it is administered. If you assume it is instead a just penalty for murder than an executed murderer has not had an injustice done to him, even if other murders in similar circumstances are not executed.

So the real issue is how often are innocent people executed. I think it is a very rare occurrence. If you could change my mind on that, than I'd move off the fence to at least opposing the current death penalty regime (even if I didn't oppose it in the abstract).
