I saw the same pair on "Face the Nation" answering questions about Bush's domestic spying. They both thought it was an illegal overreach by the chimp. Graham is a Republican lawyer. Both pointed out that Bush could have done the same thing legally, and had ALL the authority he needed to do it. Under FISA, he can order wiretaps without a warrant if time is a factor, as long as he seeks a warrant within 72 hours. Not ONE FISA warrant has been denied. The chimp could have followed the law, but CHOSE not to.
