That is the way it has always been. The framers were demagogues- I happen to have liked most of their demagoguery- but don't forget they had a revolution to sell to the masses (the masses being white men). Our founding fathers had no problems restricting the rights of people.

The Constitution may say it is "we the people" who give power to the government- but it has always been the POWERFUL who give the government most of it's power- whether it is powerful local government, or state government, of federal government. The powerless get screwed no matter what the Constitution says. Of course who is powerless changes, and how much they get screwed also changes. Ce la vie.
