Yesterday I was informed that Yahoo! has been served with a deposition subpoena duces tecum to discover the identities of persons publishing on Yahoo!'s Message Board "VAR".
I am not familiar with the requirements of the subpoena, but it appears to have been served on the deponent Yahoo! without leave of any court of jurisdiction. Generally, such a subpoena is unenforceable because it is not authorized by law. I do not know the status of the subject subpoena.
The John Does Anonymous Foundation represents anonymous internet pubishers in an effort to protect their First Amendment rights. The Foundation maintains counsel in California, the venue for the subject subpoena duces tecum, for that precise purpose. It is our intent to file a motion to quash the within subpoena, however any protective order by a court would normally apply only to the individuals that we actually represent.
If you have been notified by Yahoo! that confidential information regarding your account is being requested under this subpoena, and you are presently unrepresented in this case, I encourage you to contact me immediately.
