In my mind the premise of a class suit would be " that by knowingly enticing new clients while knowlingly not being able to give their existing clients professional, expedicious and timely service the brokerage has put their own financial interests ahead of the client and exposed them to unconscianable financial loss".
This in my mind becomes a matter also for the Securities commisssions of the Provinces in which TD Waterhouse operates.
