I have to think about your rights hierarchy. I see rights that come in three distinct species; human, property, and civil. They are not distinct, for how can you separate a man from his property without limiting his personal (human) right to enjoy it. When men come together to create a society, they relinquish some of their rights to the community, to gain civil rights that they synthesize cooperatively. The culture of that society has a lot to do with what “laws” they see fit to submit to. The idea that differing cultures (volunteer?) to disparate legal structures causes some problems. Recall some few years ago how many people thought we should “be more like the Japanese” without having any idea how their culture effected their way of doing things, and the price they were paying for it.

That reminds me of a saying from my childhood “there ain't no free lunch”. It was clear to men, women, children, and even graduate students, that the essential truth of that statement could not be ignored without peril. I guess we'll see.

The history of warfare includes ubiquitous examples of raping and pillaging. American soldiers are unique for their lack of wartime rapes. This is not a legal issue, the circumstances are similar for all soldiers, but American soldiers largely act in a different way. Our culture and sense of honor is uniquely American. Things like this (or our tendency to charity) don't fit into cost benefit calculations very easily.

The invisible hand of Adam Smith works in ways beyond simple economics.
