When judges legislate, amending the constitution is the only way for the people to express its will.

True, but maybe that is a sufficiently drastic step to cause the people to quit playing tit for tat and reconsider the wisdom of their will. The amendment move seems so knee-jerk to me. Any Constitutional amendment should give pause. An amendment is like dropping a nuke on the problem. It's a last resort, not just another raise of the ante.
