I also received the same email letter from Mr. Roche from CTRL Systems, Inc. after he had called me in response to an inquiry I had made about their product.

I did not report this email or conversation with Mr. Roche last night because I thought it prudent to first get MRPS's reply. I still think we should talk with Jimmy Gayle or Myles before we go much further with this. The main issue seems to be this;

1. CRTL claims "exclusive' rights to the design, manufacture, and trademark of ULTRAPHONICS.
MRPS claims the same right although 'exclusive' wasn't used. Both claim they bought these rights from the original company (Ultraphonics USA)

One other issue raised in my phone conversation with Mr. Roche and not in the email letter was the following:

2. Mr. Roche says Ultraphonics of North America (the precursor of Microphonics) only had "distribution" rights from Ultraphonics USA. he then related a confusing tale (to me) about how Ultra of N.A. filed some sort of "breach of contract' against UltaUSA, and severed the relationship and then went on to "reverse engineer" the original product.
MRPS claims, according to I think Dave Gore's or was it brian connolly's last conversation with MRPS, that it was CTRL which "reversed engineered' the product.

The evidence we have so far regarding trademark registration favors MRPS, but the real issue is, is there any infringement by either company on the "rights" to the product. Although, I would imagine the present products of both companies are sufficiently different so that may not be a problem either.

Anyway, I really think this deserves a call to Jimmy Gayle. If someone here has already been designated to do that, please let me know. Otherwise, i will call in a little while -
