In their questions from the bench, the justices, particularly Joyce L. Kennard, strongly suggested that they did not want to second-guess the will of the voters.

Justice Kennard wants to keep her job. She and her co-Justices are elected. Given the strong support for Prop. 8 with the voters, there could be blowback on the Justices if they invalidated Prop. 8.
