There is the slight matter of the US Constitution, whose Article III, if memory serves, declares that the Supreme Court enforces the law of the land. I don't believe that the Senate has any right to give away the Supreme Court's jurisdiction via treaty. Doubtless Obama has his own views on the subject, Constitutional law being his forte.
