I suspect that a short seller who loses money due to market maker manipulation (if it can be proven) or to false news releases would indeed have a case for a lawsuit.

However, lawyers prefer these class actions, where they can do the work of representing one person, and be paid by a hundred thousand people. The fact that short-selling is generally less-common and that there would be fewer class members in a particular case may keep the lawyers from being interested.
