to begin with, I guess it is not illegal either, if indeed there is no provision against it. However, having a "friend" do it if such a provision is in existence can very well be illegal, depending on the interpretation of the agreement. I am not a lawyer, but ideas like "China Wall" and "insider trading" seem to suggest using "friends" to park the trades are a no-no. Offhand, I can think of some company being fined by SEC - not hard enough though - for parking trades for Ivan Bowlsky [sp?]
