If the SEC had proof of a 'paid basher', the same law would apply. Legally, it is the principle involved, and this is the same whether it is a paid basher or a paid promoter. In the SEC's eyes, they both are required to disclose, or be subject to penalties.

Agree that there are probably some paid bashers out there, but much fewer than paid promoters.
