The Free Republic post was factually incorrect. The dissenters quoted from a very famous Supreme Court case, National Socialist Party vs. Skokie, which you probably recall, remember the Nazis marching in Skokie, Illinois?

The decision in that case [Nazis vs. Skokie] is pretty short and simple -- it's about when to grant an injunction. Nothing about Nazis or socialism.

When courts write opinions, they always give a lot of citations to prior cases that govern their reasoning. So all Ginsburg was saying is "we should treat this case like we did the Skokie case." That's all.

This is why non-lawyers get confused. It's not all that complicated but there really is a learning curve.

A first year law student could have explained it.
