That is a very strong indictment against a nation that believes that they are governed by the rule of law. What legal basis, then, do they do this by?

You're kidding right? The Constitution. The Fed Pen system is under the control of the Administration, if the President says remove a prisoner, it's done. If you don't like a "pardon", the President has full authority to "commute the sentence". In espionage cases, they didn't bother. Nobody bothers with these little technicalities when it comes to bilateral deals.

If people want a review process associated with Presidential authority in these matters, they need to change the Constitution. At the moment, I don't have a position on that....but I'm, by default, reluctant to tinker with the Constitution.
