My understanding, second-hand, from a call to IOM investor relations
is that Nomai may be able to market their disks in France and Germany
but will run into serious obstacles with respect to fair business practices
here in the U.S.

I am not an expert on patent law, so I wonder if even if certain
mechanisms are covered under US patent, is that enforceable overseas?
Also, how big of a chunk of pie is France/Germany?

Personally, I have a hard time believing they will be able to
sell these things in the US without running into legal barriers.

If I may raise a possibly disturbing point, how does this situation
compare to AMD making PC processors which are clones of Intel's?
(Though Intel seems to be doing just fine even with the clones out there...)
