Are you sure they were "bad" guys? For all we know, the data could have included people in the protected witness program. Like you, I have more than a few moral qualms about another charge, if proven (and I think it would be pretty easy to prove if true and next to impossible if not):

In addition, according to the indictment, Mr. Elgindy extorted free or cheap shares of stock from the insiders of companies he had targeted in exchange for his agreement to lay off -- to stop shorting the companies and stop spreading negative information about them.

It has been my experience that companies don't give away stock out of the goodness of their hearts.
