Yes it is. He swore an oath to support and defend the constitution.


Its the president's position to support and defend the constitution......exactly. It his not his role to reflect on every piece of legislation and determine if its constitutional or not. There is an important distinction between the two roles for good reason.........its part of the checks and balance system.

Its the responsibility of the judiciary to have the final say on the matter (absent amendment). The president doesn't have the final say, but he does have to interpret the constitution (or have his advisers interpret it for him) in order to perform hid duties.

Tim, at last count, Bush has used the signing statement 750 times. Are you telling me that with all the legal expertise assisting Congress in writing legislation that they have managed to come up with 750 bills in 5+ years that are unconstitutional? If so, Congress needs new legal help.
