Harry, I just think juries will be very unfriendly to such claims--ie private lawsuits. I think Judge Jackson appears to be--at least up until now very biased. Sooner or later lawyers will get discouraged from taking action that will result in nothing. I don't expect Jackson's actual ruling to be so one sided because that part of his judgement will have to stand up in appeals. He knows that he is now perceived to have overruled the Appeals judges by saying that integration on IE into Windows was just the action of a monopolist. How is the higher court going to take this. IMHO, not very well!

That is a reason MSFT might not be tempted to settle unless of course the government demands become reasonable. I saw Blumenthaul say that they were looking for tough remedies. That does not seem like a good way to start any negotiation.

MSFT has to hire great speakers---the type that can hold an audience's attention--i was not impressed by Bill Gates or Bob Herbold. They need to find someone who has incredible public speaking skills. With such individuals, they need to blitz media directly and indirectly through speeches. I don't think a MSFT funded organization is the way to go---the reporters always bring up the question of funding. That makes it appear that they are concealing something. Instead they need to very clear that they are representing MSFT and on behalf of consumers.

Conclusion: They need someone who can speak like Joel Klein. I found his manner very effective. I am glad he does not do many public appearances as that will only hurt MSFT's image. They need to find a lot of people like Klein -sorry--i mean people with his public speaking abilities.
